Meta must provide a tracking-free version of their services that's accessible without having to pay.
Our report outlines alternatives to 'consent or pay' that aren't reliant on harvesting users' personal data.
This includes contextual advertising or subscriptions for advertisers.
In 2024, 98% of Meta’s $165bn of revenue came from advertising with nearly $70bn profit.
Profit has come at the expense of our privacy and the right to opt-out threatens Meta's intrusive advertising model.
So Meta is expected to expand 'consent or pay' to keep lining their pockets. You either pay for its services or let #Meta use your data for advertising.
Meta recently settled a case, agreeing not to use personal data for profiling in order to flog ads.
Since then thousands have used tools by ORG and other groups to exercise their right to opt-out.
But Meta is playing for time to figure out how to sustain surveillance advertising.
Pay per privacy?
ORG's new report warns that Meta mustn't use 'consent or pay' to bypass data protection law.
It's not lawful to force users into paying so that their personal data doesn't get used for targeted advertising, aka stalker ads. Users must have the right to opt-out!

Choosing the right email provider is more important than ever for European businesses in 2025. With the new Trump administration and the US CLOUD Act, the risk to confidential business data has increased significantly. Simultaneously, breaches of GDPR can result in substantial penalties.
In uncertain times, the right choice can represent a decisive competitive advantage.

In a historic win for data protection and privacy, the High Court of Ireland has this afternoon granted ICCL permission to take Ireland’s first ever class action. The lawsuit targets Microsoft’s vast online advertising business.
The litigation is anticipated to affect Microsoft’s operations across Europe, because Ireland is the venue of Microsoft’s EU headquarters.
Dr Johnny Ryan, Director of ICCL’s Enforce unit, is leading the case. Speaking after the hearing, he said:
“The significance of today's decision extends beyond just Microsoft. Ireland is also the HQ venue for Google, Meta, TikTok, X and Apple. Today, nine years and one day after the GDPR was first introduced, we are finally opening up a way to enforce it against big tech on behalf of everyone. Regrettably, the Ireland’s Data Protection Commission has paralysed enforcement of EU data law. But that need no longer be the case.”
The litigation follows research by ICCL Enforce that uncovered how people’s intimate relationships, finances, and other secrets, are broadcast by Microsoft into the Real-Time Bidding (RTB) advertising system. Microsoft’s RTB system operates behind the scenes on websites and apps to match advertising to specific people.
ICCL argues this system is exposing users to malicious profiling and discrimination. It also argues that the system is undermining European security.
ICCL is taking the legal action on behalf of all affected people in Ireland under the new EU Collective Redress Directive. The organisation hopes to force Microsoft to bring its systems into compliance with the EU’s General Data Protection Regulation (GDPR).
Posing as a data buyer, ICCL Enforce obtained thousands of RTB data “segments” about Irish people. These include information such as whether a person gambles, their finances and debt, and even such sensitive information as whether the person works in a sensitive national security role.

Also, I have @maxschrems to thank for legally clarifying that disclosing this sensitive/special category personal data here publicly does not give anyone the right to use it for #surveillance #advertising or ‘ #AI ’ training (or any other #gdpr purpose beyond enabling access to these Mastodon posts, as I intend.)
I wrote an opinion piece for the Irish Examiner on the increasing risks to Ireland's data sovereignty given the recent developments in international policies and the threat of trade wars

I didn't see Meta's dark pattern coming when deleting an Instagram or Facebook account. After reassuring that you want out, they hit you with a "We'll just deactivate your account now and delete it in a month. If you change your mind before, log in and we'll reactivate it."
As the digital drugs they are, imagine trying to quit cigarrettes while tobacco companies are like "sure, you can remove your stash starting next month."
This should be illegal.
Better don't believe that Meta will always respect objections to their use of personal data for the training of their LLMs. Imho, even now, they're providing the opt-out mainly to check the temperature.
If the backlash isn't strong enough now, expect them to change their terms of service sooner or later, claiming all personal data on their platforms for their LLMs. They won't back down. And they certainly won't respect anyone's privacy!
